I have offered to remove some trees, in agreement with my neighbor, if the HOA will sign a document that they will not pursue any other tree removal in the future. They have not signed it, and I won't remove any trees without that signed document. Do I have legal recourse? What course do you recommend?

I recommend that if you want information about legal recourse, you contact a real live lawyer rather than bozos like me. People with the best of intentions give incorrect legal advice online constantly. Don't trust it even when it sounds right.

I would not expect the HOA to sign any waiver which may create a conflict with other people.

I think it is unusual that the trees were allowed to remain for 8 years, but if they violate a condition of a contract you signed, there would be no "grandfather clause" or "statute of limitations"

Because I do not have the terms of your contract, or the reason for the complaint, I do not think I, or anyone else in Yahoo, can answer that quesiton without reading the paperwork.
